Terms and Conditions

Disclaimers:

All items are sold “AS IS, WHERE IS, with NO WARRANTY expressed or implied.

Most items are used and may have scratches, dents, dings, holes, funky odors, etc. unless expressively noted as new in

box.

Descriptions are believed to be accurate but not guaranteed. Any mention of an item’s condition is not an official

grading of the item’s condition. When you are not certain of the condition or wear of an item, please bid accordingly.

Preview is strongly suggested to gauge the condition of each piece and to gain perspective on the size or number of

items in each lot. Extra care is taken to be as descriptive as possible but not guaranteed.

Onsite or wholesale auctions may have items in the attic, basement, barn, dark alley, scary dungeon rooms and other

places that your spouse may be hesitant to enter. Please consider attending the preview to help understand any

complications in removing your treasure.

If you have any difficulties, we will do our best to work with you on solutions. We will try our best to make sure that

your onsite or online auction experience is a good one.

Bidding:

You must be registered to place a bid on an item. By placing a bid, you agree to all the terms and conditions that apply to

that auction.

Before you bid, please read all information concerning location of auction, days of pre-views and pick-ups as well as

conditions that apply to each.

All bids are final. We do not retract or remove a bid.

We respect your privacy and that of the other bidders. We will not release your information to anyone without your

permission.

You are bidding on the item in the photograph. Occasionally, the wrong description is displayed. Always look at the

photo! Please contact Huffman's Auctions if you find an error in the catalog so we can make the correction as needed.

Payment:

A 10% buyer’s premium (plus state and local tax) will be added to each purchase. If your winning bid is $100.00, at

check-out you will be charged $110.00 plus tax.

Payment can be made with a credit or debit card (Visa, MasterCard, and Discover) using the online payment link found

in the email notification received upon winning.

Payment can be accepted at the pickup location if pre-arranged.

Cash and/or approved checks will also be accepted.

Payment must be made within 24 hours of the auction ending. Failure to pay will result in revocation of bidding

privileges.

A $25.00 reactivation fee of a suspended account will be required. Reactivation will be determined on a case-by-case

review by the manager.

Registration is a legal and binding agreement to accept responsibility for payment. Deviation from this agreement can

result in legal action and fees.

Preview:

Preview is an “open house” to allow our customers to inspect the items before they bid or buy.

Items are identified by the lot number affixed to the item.

Preview is highly recommended so you can make your own determination of quality, size, condition, weight, item

location, and all the other variables that are difficult to convey in a photo.

Unless the specifically addressed in the description, it is safe to assume the items have NOT been tested. You are

welcome and encouraged to test any item during the preview times listed.

Pickup:

All items must be removed during the schedule pickup time(s). Because of Covid-19 restrictions we will stager pick up

times.

Any items not removed during the pickup times will become the property of Huffman's Auctions (unless other

arrangements have been made).

Please bring plenty of help and proper equipment needed to remove your items. Auction staff is not available to assist

with loading. Don't bring a small vehicle to take home a entire living room suite please.

If you are unable to make the pickup time due to a flat tire, traffic jam, car fire, sudden illness, deceased relative, or any

other catastrophic event, please contact Huffman's Auctions at 540-460-3600 or huffmansauctions.com. We can make

special arrangements (for a fee) in most cases. Items MUST be paid in full to qualify for temporary storage. Items left

over 10 days becomes the property of Huffman's Auctions unless other arrangements are made in writing.

Items not claimed by the end of the scheduled pickup times will be assessed a $5.00 convenience fee.

Furniture and any large items (items that do not fit into a box) will be subject to an additional $20 storage fee if the

items are not picked within 24 hours of pick- up time scheduled. After 1 week, the items will be considered abandoned

and / or forfeited by the buyer.

For Onsite Auctions:

All items are to be removed at the end of the auction unless arrangements are made PRIOR to closing sale time.

Firearm Sales:

All guns purchased will be required to go thru a licensed gun dealer and buyer pays all transfer costs.

Bidder must be eligible to purchase a firearm under local, State, and Federal guidelines.

Shipping provided to continental US FFL holders for most gun purchases. Additional charges will apply. See details in the

firearms auction for shipping rates.

Staggered Closing:

The online auction closes 3 items per minute (may differ on each auction). This feature will close the bidding on

intervals. This feature works great with the auto-extend feature to closely emulate a ‘live’ auction.

Dynamic Closing:

The closing time of an item is automatically extended an additional 2 minutes whenever a bid is placed within the last 2

minutes of the item’s closing time. Thus, if an item is set to close at 6.:00 pm, and a bidder places a bid on the item at

6:02 pm, the item’s closing time will be extended to 6:04 pm. If another bid is placed at 6:05 pm, the item’s closing time

will be extended to 6:07 pm, and so on.

Bid Notification:

If you have been out-bid you will be notified by email or phone notification (app users) ONLY UNTIL the last 2 minutes of

the item scheduled closing time. To quickly review your bids and see if you have won, you can utilize the ‘Your Items’

feature. Items that you have been outbid on will be clearly marked.

Winning Bidder Notification:

You will be contacted by email or phone notification (app users). If you feel you have won an item and have not

received an email you must notify us by email no later than 9:00 am the next day. If you do not receive an emailed

invoice then you did not win any items at the online auction.

In the event an item is not available for pickup, the buyer must notify our on-site staff and file a claim by replying to

your original emailed invoice noting what was not available within 24 hours of the pickup date. After 24 hours, the

Auctioneer and buyer agrees that no adjustment or refund will be made.

Images Don't Guarantee Items:

For demonstration purposes various equipment may be joined. Do not assume a lot consists of more than one item

simply because they are connected or pictured together. Please inspect the lot numbers and read the descriptions of

each item carefully.

Catalog Inaccuracies:

You are bidding on the item in the photograph. Occasionally, the wrong description is displayed. Always look at the

Warranty and Condition of Items Sold:

All items are sold “AS IS, WHERE IS, with NO WARRANTY expressed or implied by the lot number affixed to the item

without any implied or expressed warranty. Keep in mind that these items are used and may have light surface

scratches and or dents / dings. Preview is suggested in order to gauge the condition of each piece. Descriptions are

believed to be accurate but not guaranteed. Any mention of an item’s condition within the listed description is not an

official grading of the item’s condition. Please view when possible any item you are interested in bidding on. We will

strive to supply you with as much layman information as we can. You are bidding on the described item, not the photo.

Removal:

Bidders are responsible for their own removal. Any item NOT picked up by the set time will be considered abandoned

unless other arrangements are pre-made. . Removal shall be at the expense, liability and risk of the purchaser. Purchases

will be released upon presentation of a paid email receipt. Please ensure that movers or anyone picking up items on

your behalf have your paid receipt at the pickup location. No items will be released without a paid email receipt.

Abandoned Items/Delinquent Accounts:

The Auctioneer will have the option of reselling, removing, storing or abandoning, at the expense and risk of the

purchased items not paid for and/or removed within the specific time. The buyer agrees to pay all deficiencies, legal,

collection, transportation and storage expenses associated with delinquent accounts or abandoned items.

Choose Wisely:

Our goal is for you to get a good deal, procure a good item, provide a good profit for the sellers and to have a good time

doing it! However, when you bid on the wrong item or decide an item is not suited for your intended use, our clients

are not willing to assume the cost of your mistakes. When in doubt about condition, completeness or suitability for

intended use, please bid accordingly and with caution.

The auctioneer reserves the right to add or remove items from the auction, split or combine lots, add minimum bids or

reserve prices, cancel, suspend, extend or reschedule an individual item and or auction event, make changes to the

auction closing times or inspection or removal times. Any controversy or claim arising out of or relating to this contract

and/or agreement, or breach thereof, shall be settled by arbitration in accordance with the Commercial Arbitration

Rules of the American Arbitration Association, and judgments upon the award rendered by the arbitrator(s) may be

entered in any court having jurisdiction thereof. Venue will be in Buena Vista, Virginia.

Liability:

Auctioneers and Sellers liability shall be limited to the refund of bidders purchase price.

Limitations:

The above-stated Conditions of Sale cannot be altered except in writing by The Auctioneer.
